Melba braided hair for eleven years. Then Louisiana said she needed 500 hours of cosmetology school — chemical peels, thermal styling, none of it related to what she did. Tuition was five to fifteen grand. She shut down.
We start on the ground, where a woman lost her livelihood because a licensing board staffed by cosmetologists who would be her competitors decided the public needed protection from braiding. That is not safety. That is a cartel with a government seal.
The pattern is everywhere. Arizona licensed food trucks out of competition with restaurants. Texas licensed florists. Twelve hundred occupations now require permission. The COVID mandates stripped the abstraction away — firefighters who entered burning buildings during a pandemic were fired for refusing a medical procedure. The city called them heroes in March 2020 and fired them in November 2021.
The communitarians point to Shirakawa-go. We note what they leave out: those rules emerged from the bottom. Not imposed by a distant legislature with no feedback. Congress exempted itself from the ACA. Officials who enforced lockdowns dined at French Laundry. The integralists say our resistance is developmental. Convenient — any objection becomes evidence of immaturity. The system hackers are our cousins. They route around what we want to dismantle. Now the surveillance architecture makes it concrete. The system no longer waits for you to break a rule. It watches to see if you might.
Where we concede ground: Pure voluntarism has a body count. Building codes save lives. Climate is a genuine hard case.
What would change our mind: Five delicensed low-risk occupations showing statistically significant consumer harm increases over ten years.
